1. About these terms
These terms apply to the mindo service provided by MM Creative Ltd, a company registered in Malta (company number [C 00000]), with its registered office at [registered address] ("mindo", "we", "us"). By requesting a free visual or starting a plan, you agree to these terms on behalf of your business. mindo is a service for businesses, not consumers.
2. Our service
mindo creates visuals, designs and social media content for product brands, using AI tools directed and reviewed by our creative team. What is included in each plan, how many deliverables you get, and how many revisions are included are shown on our pricing page at the time you sign up.
3. Free visual
We offer one free visual per brand so you can try mindo. No payment details are needed. We may decline a request, for example if the product or brief falls outside what we can produce. You may use your free visual under the same licence described in section 7.
4. Plans, payment and cancellation
- Plans are billed monthly, in advance, in pounds sterling (GBP). VAT is added where applicable.
- Your plan renews each month until you cancel. You can cancel any month by emailing us; cancellation takes effect at the end of the billing period you have already paid for.
- We do not refund partial months. Deliverables that are not used within a billing period do not carry over to the next one.
- If a payment fails, we may pause deliveries until it is resolved.
- We may change our prices with at least 30 days' notice. The new price applies from your next billing period, and you can cancel before then.
5. Deliveries and revisions
We deliver your work on the schedule of your plan, usually weekly. A revision is a change to a delivered visual within the original brief, such as adjusting colours, cropping or details. A new concept, product or scene counts as a new deliverable, not a revision. Unused revisions do not carry over.
6. Your content and responsibilities
- You keep ownership of everything you send us, including product photos, logos and brand assets.
- You confirm that you have the right to use everything you send, and that it does not infringe anyone else's rights, including trademarks, copyright and the image rights of people shown.
- You give us permission to use your content only to provide the service to you.
- You are responsible for checking every visual before you publish it, including how your product, colours, claims and any text are shown.
7. Ownership and licence
Once the relevant payment is made, we grant you a worldwide, perpetual, royalty-free licence to use, edit and publish the visuals we deliver for any lawful commercial purpose, including advertising, social media, websites and print. You may not resell or distribute the visuals as standalone stock content.
Because our visuals are created with AI tools, copyright protection for them may be limited in some countries. We do not show your work publicly, including in our portfolio, without your written permission.
8. Acceptable use
We will not create content that is illegal, misleading, defamatory or discriminatory, that infringes someone else's rights, or that imitates another brand. We may refuse or stop work on any request that breaks this rule.
9. Liability
We take care with every delivery, but we cannot guarantee specific commercial results. Our total liability to you under these terms is limited to the fees you paid us in the three months before the claim arose. We are not liable for indirect losses, such as lost profits, revenue or opportunities. Nothing in these terms limits liability that cannot be limited by law.
10. Ending the service
We may suspend or end your plan if you break these terms or do not pay, after giving you notice and a reasonable chance to fix the problem where possible. Sections 6, 7 and 9 continue to apply after your plan ends.
11. Changes and governing law
We may update these terms from time to time; the date at the top shows the latest version. If a change materially affects active plans, we will email you at least 30 days before it applies. These terms are governed by the laws of Malta, and the courts of Malta have jurisdiction over any dispute.
